The Progress of a Case
If you are suffering from an injury caused by someone else’s negligence, you may be understandably anxious to resolve your case as quickly as possible. However, not giving your case enough time to properly develop can significantly hamper its successful resolution.
A personal injury case involving premises liability or a serious injury from a motor vehicle accident can take up to two years from start to finish. Here is a brief overview of the steps involved in a complete personal injury case.
First Steps
Getting medical attention is always the very first step after your injury. As soon as possible after receiving initial treatment, it’s time to consult with a lawyer. Even if you have not yet received medical treatment, it is not too late to treat your injuries. The Parks Law Firm, P.C. offers a free initial consultation either in person at the office or via telephone, in order obtain information about how your injury occurred and its severity. Mr. Parks can also provide information and referrals for obtaining treatment at no out-of-pocket cost to you.
Initial Case Evaluation
At the conclusion of your consultation, your attorney will give you an evaluation of the relative strengths of your case. At this point, you and your attorney may decide to pursue a personal injury case. In this situation, there will be important paperwork to complete to start the process of filing your claim with the insurance companies. These will include an engagement agreement with the Parks Law Firm, P.C. and a HIPAA release to obtain medical information related to your case. You will also be assigned a designated case manager to serve as your dedicated point of contact throughout your case.
Follow Through
Once all of the necessary paperwork is completed, your attorney and case manager will file a claim against the at-fault party’s insurance. The firm will work to get liability accepted and get compensation for your property damage. The firm will also work with you and your medical providers to arrange for any necessary medical treatment. Please make sure to continue and complete any prescribed medical treatments for your injuries as your attorney works on your case. During this time, your lawyer will investigate the claim and will request all necessary information from the police, from any witnesses and from the at-fault party. Likewise, your attorney will have to share information with them as well. It is essential to communicate promptly and respond to any requests for information or assistance to facilitate the development of your case.
Settlement and Litigation
Many times, personal injury cases do not go to trial. Once you have completed treatment, the Parks Law Firm, P.C. can begin negotiations to settle your claim with a settlement agreement that is acceptable to both parties. You will be informed of all offers made during this process and with the assistance of your attorney, determine if the insurance company’s offer is acceptable. If the offer is acceptable, your case will be concluded. If the offer is not deemed acceptable, then the analysis will turn to determining if the case is suitable for litigation. The Parks Law Firm, P.C. focuses on personal injury cases and is well-versed in settling cases as well as taking them to trial. The firm gets personally involved in your case and are committed to its success.
Trial
For those cases that cannot be resolved satisfactorily through a negotiated settlement, trial is the ultimate option. At the Parks Law Firm, P.C., Mr. Parks has years of experience in successfully litigating claims where the insurance company will not make a reasonable settlement. If your case does go to trial, your attorney and case manager will explain and guide you through every step of the process. Mr. Parks stands committed to the successful resolution of your claim.
