Someone rear-ended me; what do I do?

If someone rear-ended you, check for injuries, get help when needed, and document the collision from a safe location. Exchange information and report the crash to your insurance company even if you believe the driver behind you was clearly responsible.

Rear-end crashes raise a few specific questions: whether you were pushed into another vehicle, whether symptoms developed afterward, and what evidence shows the sequence of impacts. Those details matter in a Texas claim.

Check Everyone Before Examining the Bumper

Ask whether your passengers are hurt. Call 911 for injuries or immediate danger and follow the dispatcher’s directions.

Texas requires immediate notification to law enforcement when a crash causes injury, death, or vehicle damage that prevents normal, safe driving. Stay at or near the scene as required to exchange information and provide assistance.

If nobody is injured and the car can be moved safely, get out of the travel lanes. Don’t stand between vehicles to inspect the damage while traffic is passing.

Explain the Order of Impacts

Write down whether you were stopped, slowing, or moving when you were hit. Note the traffic signal, road conditions, and anything you observed before the collision.

If several cars were involved, describe what you felt and saw in order. Were you hit from behind before contacting the vehicle ahead? Did you feel one impact or more than one? Say when you cannot tell.

Photograph the front and rear of your vehicle, the other vehicles, and the surrounding roadway when safe. Get witness contact details and preserve any dashcam footage. Avoid replacing the recording with a shortened or edited version.

Understand Why Rear-End Fault Still Requires Evidence

Texas Transportation Code Section 545.062 requires a following driver to leave enough distance to stop safely, considering speed, traffic, and road conditions.

That rule is relevant, but a rear-end impact does not automatically establish negligence as a matter of law. In Roberts v. Staples, a Texas appellate court explained that a claimant must prove negligent conduct and its causal connection to the claimed harm.

Preserve evidence even if the other driver apologizes. A useful account explains how the crash happened rather than relying entirely on the location of the damage.

Watch for Neck Pain and Other Symptoms

Whiplash is a neck injury associated with sudden head movement. Symptoms can include neck pain, stiffness, headaches, and shoulder or arm discomfort, and they may take several hours to develop. A clinician can evaluate your symptoms and determine appropriate care.

Seek emergency care for warning signs such as repeated vomiting, worsening headache, seizures, weakness, or difficulty waking after a possible head injury.

Tell the provider about the collision and when symptoms started. Be clear about prior symptoms as well as new ones. Keep the visit instructions and ask what changes should prompt further care.

Report the Crash and Preserve the Records

Notify your insurer promptly and ask what your policy requires. If another driver caused the collision, you can also pursue a claim with that driver’s insurer. Coverage and payment still require review.

If police investigated, obtain the report when it becomes available through the agency or TxDOT’s eligible-requester process.

Create separate folders for medical records, vehicle damage, and insurance correspondence. Keep a dated note of important calls so you know what has been requested and what remains unanswered.

Clarify Repairs, Transportation, and Available Coverage

Ask the repair shop for an inspection and a written estimate. Explain any change you have noticed, such as a trunk that no longer closes properly, without trying to diagnose the problem yourself.

Before authorizing work, ask who will approve additional damage and who is responsible for charges that insurance disputes. Confirm rental arrangements separately.

If the other driver is uninsured or lacks enough coverage, your uninsured/underinsured motorist insurance may help if you carry it. Benefits depend on the policy and circumstances.

Review an Offer Before Signing a Release

Read the settlement paperwork and identify which claims it resolves. TDI advises discussing possible future medical treatment with your doctor before signing an injury release.

Ask an attorney about unresolved responsibility or deadline questions. Texas generally imposes a two-year personal-injury filing period from accrual, but exceptions and separate requirements can matter.
